Tariffs Legal Services: Strategic Guidance, Compliance & Disputes
Tariff policy is constantly evolving, impacting businesses that import and export goods worldwide. Our experienced customs and international trade attorneys provide strategic legal guidance to help companies prepare for what’s ahead and navigate compliance requirements.
We assist with classification, requests for exclusions from additional tariffs, tariff mitigation strategies, assisting to mitigate Government enforcement actions, and more. Whether you need proactive planning, regulatory compliance support, or representation in disputes, our team is here to protect your interests and keep your supply chain running smoothly.
We can assist with:
- Classification – The Harmonized Tariff Schedule of the United States (HTSUS) is the primary resource for determining tariff classifications and deciphering customs duties owed for goods imported into the United States. We can help ensure your goods are classified properly and/or request a binding ruling to give your business certainty.
- Enforcement Actions – Duty evasion is a serious crime and can result in serious monetary penalties or even prison time in the case of fraud. Diaz Trade Law has extensive experience navigating enforcement actions and can help ensure your business has the best chance of a positive outcome.
- Tariff Mitigation – There are many ways to legally minimize the burden of tariffs including first sale, negotiating Incoterms with suppliers, tariff engineering, duty deferral via a bonded warehouse or a FTZ, duty drawback if the goods will be exported from the United States, and more.
- Exclusions – While 301/232 exclusions are not currently available, we are monitoring and can assist importers if/when these exclusions become available again. Generally, applications for exclusions have very specific requirements and should be submitted with the assistance of a customs attorney.
