Trump, ruling that IEEPA does not authorize the president to impose tariffs.\u00a0<\/em><em><span class=\"EOP SCXW229719275 BCX4\" data-ccp-props=\"{}\">Read more about the litigation <a href=\"https:\/\/diaztradelaw.com\/supreme-court-rules-ieepa-tariffs-are-unlawful\/\" target=\"_blank\" rel=\"noopener\">here.<\/a><\/span><\/em><\/p>\n<h3><strong>Mexico &amp; Canada Tariffs under IEEPA<br \/>\n<em>Status: Mexico 25% took effect March 4, 2025<br \/>\nCanada 35% took effect August 1, 2025<br \/>\n<\/em><\/strong><strong><em>CBP suspended collection February 22, 2026 pursuant to the Supreme Court IEEPA decision<\/em><\/strong><\/h3>\n<p>On February 1, 2025, President Trump first issued a\u00a0<a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/02\/fact-sheet-president-donald-j-trump-imposes-tariffs-on-imports-from-canada-mexico-and-china\/\" target=\"_blank\" rel=\"noopener\">fact sheet<\/a>\u00a0and thereafter signed two executive orders imposing new tariffs on imports from\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/imposing-duties-to-address-the-flow-of-illicit-drugs-across-our-national-border\/\" target=\"_blank\" rel=\"noopener\">Canada<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/imposing-duties-to-address-the-situation-at-our-southern-border\/\" target=\"_blank\" rel=\"noopener\">Mexico<\/a>:<\/p>\n<ul>\n<li>25% tariff on imports from Canada<\/li>\n<li>25% tariff on imports from Mexico<\/li>\n<\/ul>\n<p>The tariffs on imports from Canada and Mexico were initially set to take effect February 4, 2025, but were delayed by one month following commitments made by both countries to secure the border and stop the flow of drugs into the United States.<\/p>\n<p>On March 5, 2025, the Administration announced a temporary one-month pause on automobile tariffs for Mexico and Canada. Subsequently, on March 6, 2025, President Trump temporarily suspended tariffs on certain goods from Canada and Mexico that meet the United States-Mexico-Canada Agreement (USMCA) requirements, effective March 7, 2025. The Federal Register Notice for Canada can be found\u00a0<a href=\"https:\/\/www.federalregister.gov\/public-inspection\/2025-03664\/implementation-of-additional-duties-on-products-of-canada-pursuant-to-the-presidents-executive-order\" target=\"_blank\" rel=\"noopener\">here<\/a>, the Federal Register Notice for Mexico can be found\u00a0<a href=\"https:\/\/www.federalregister.gov\/public-inspection\/2025-03665\/implementation-of-additional-duties-on-products-of-mexico-pursuant-to-the-presidents-executive-order\" target=\"_blank\" rel=\"noopener\">here<\/a>. Customs and Border Protection (CBP) issued guidance on the additional tariffs on imports from\u00a0<a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3d5b0a5?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">Canada<\/a>\u00a0and\u00a0<a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3d5afad?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">Mexico<\/a>\u00a0and\u00a0<a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3d062f4?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">China<\/a>. The official CBP statement can be accessed\u00a0<a href=\"https:\/\/www.cbp.gov\/newsroom\/announcements\/official-cbp-statement-tariffs#:~:text=Pursuant%20to%20these%20Executive%20Orders,(USMCA\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n<p>On March 11, 2025, two Federal Register Notices were issued, amending the Notice of Implementation of Additional Duties on Products of Mexico Pursuant to Executive Order 14194 and the Notice of Implementation of Additional Duties on Products of Canada Pursuant to Executive Order 14193. These Federal Register amendments notices can be accessed [<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/03\/11\/2025-03900\/amendment-to-notice-of-implementation-of-additional-duties-on-products-of-mexico-pursuant-to-the\" target=\"_blank\" rel=\"noopener\">here<\/a>\u00a0for Mexico] and [<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/03\/11\/2025-03901\/amendment-to-notice-of-implementation-of-additional-duties-on-products-of-canada-pursuant-to-the\" target=\"_blank\" rel=\"noopener\">here<\/a>\u00a0for Canada]. Both notices reduced the duty on potash from 25% to 10%.<\/p>\n<p>Energy resources from Canada will have a lower 10% tariff. President Trump also signed two executive orders preserving de minimis treatment for\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/amendment-to-duties-to-address-the-flow-of-illicit-drugs-across-our-northern-border\/\" target=\"_blank\" rel=\"noopener\">Canada<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/amendment-to-duties-to-address-the-situation-at-our-southern-border\/\" target=\"_blank\" rel=\"noopener\">Mexico<\/a>\u00a0until \u201cadequate systems are in place\u201d collect tariff revenue from these shipments.<\/p>\n<p>On July 31, 2025, President Trump signed an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/07\/amendment-to-duties-to-address-the-flow-of-illicit-drugs-across-our-northern-border-9350\/\" target=\"_blank\" rel=\"noopener\">Executive Order<\/a> increasing tariffs on Canada from 25% to 35%. <span class=\"TextRun SCXW12007176 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW12007176 BCX4\">The same day, CBP published CSMS <\/span><\/span><a class=\"Hyperlink SCXW12007176 BCX4\" href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3ec01d1?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"TextRun Underlined SCXW12007176 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW12007176 BCX4\" data-ccp-charstyle=\"Hyperlink\">#65798609<\/span><\/span><\/a><span class=\"TextRun SCXW12007176 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"> <span class=\"NormalTextRun SCXW12007176 BCX4\">regarding the<\/span> <span class=\"NormalTextRun SCXW12007176 BCX4\">additional<\/span><span class=\"NormalTextRun SCXW12007176 BCX4\"> duties.. <\/span><span class=\"NormalTextRun SCXW12007176 BCX4\">Effective August 1, 2025, <\/span><span class=\"NormalTextRun SCXW12007176 BCX4\">except for <\/span><span class=\"NormalTextRun SCXW12007176 BCX4\">energy goods<\/span><span class=\"NormalTextRun SCXW12007176 BCX4\">, <\/span><\/span><span class=\"TextRun SCXW12007176 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW12007176 BCX4\">goods covered by the USMCA<\/span><\/span><span class=\"TextRun SCXW12007176 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW12007176 BCX4\">, <\/span><span class=\"NormalTextRun SCXW12007176 BCX4\">and other <\/span><span class=\"NormalTextRun SCXW12007176 BCX4\">exempted goods, <\/span><span class=\"NormalTextRun SCXW12007176 BCX4\">imports from Canada are subject to <\/span><span class=\"NormalTextRun SCXW12007176 BCX4\">a<\/span><span class=\"NormalTextRun SCXW12007176 BCX4\"> 35% <\/span><span class=\"NormalTextRun ContextualSpellingAndGrammarErrorV2Themed SCXW12007176 BCX4\">IEEPA\u00a0 <\/span><span class=\"NormalTextRun ContextualSpellingAndGrammarErrorV2Themed SCXW12007176 BCX4\">Fentanyl<\/span> <span class=\"NormalTextRun SCXW12007176 BCX4\">Tariff<\/span><span class=\"NormalTextRun SCXW12007176 BCX4\">.<\/span> <span class=\"NormalTextRun SCXW12007176 BCX4\">Transshipment<\/span><span class=\"NormalTextRun SCXW12007176 BCX4\"> of Canadian goods will be subject to a 40% tariff.\u00a0<\/span><\/span><span class=\"EOP SCXW12007176 BCX4\" data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h3><strong>China Tariffs under IEEPA<br \/>\n<em>Status: <\/em><\/strong><strong><em>CBP suspended collection February 22, 2026 pursuant to the Supreme Court IEEPA decision.<\/em><\/strong><\/h3>\n<p>On February 1, 2025, President Trump first issued a\u00a0<a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/02\/fact-sheet-president-donald-j-trump-imposes-tariffs-on-imports-from-canada-mexico-and-china\/\" target=\"_blank\" rel=\"noopener\">fact sheet<\/a>\u00a0and thereafter signed an executive order imposing a new 10% tariff on imports from China and Hong Kong.<\/p>\n<p>On March 3, 2025, a\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/further-amendment-to-duties-addressing-the-synthetic-opioid-supply-chain-in-the-peoples-republic-of-china\/\" target=\"_blank\" rel=\"noopener\">further amendment<\/a>\u00a0was issued via executive order, increasing the tariff rate on imports from China from 10% to 20%. The corresponding Federal Register Notice can be found\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/03\/06\/2025-03677\/further-amended-notice-of-implementation-of-additional-duties-on-products-of-the-peoples-republic-of#:~:text=Executive%20Order%2014195%2C%20as%20amended%20by%20Executive%20Order%2014200%20and,those%20encompassed%20by%2050%20U.S.C.\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n<p>The IEEPA tariffs apply in addition to any general rate of duty, Section 301 duty, or Section 232 duty that may be applicable to articles of Chinese origin. A full list of Section 301 China tariff classifications can be found on the\u00a0<a href=\"https:\/\/hts.usitc.gov\/reststop\/file?release=currentRelease&amp;filename=China%20Tariffs\" target=\"_blank\" rel=\"noopener\">HTSUS<\/a>\u00a0website administered by the U.S. International Trade Commission.<\/p>\n<h3><strong>Brazil Tariffs Under IEEPA<br \/>\n<em>Status: Went info effect, August 6, 2025. CBP suspended collection February 22, 2026 pursuant to the Supreme Court IEEPA decision.<\/em><\/strong><\/h3>\n<p>On July 30, President Trump signed <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/07\/addressing-threats-to-the-us\/\">an executive order<\/a> imposing an additional 40% tariff on imports from Brazil. This tariff applies on top of the 10% reciprocal tariff, bringing the total tariff on Brazilian goods to 50%.\u00a0 The EO declared a new national emergency under IEEPA citing the Brazilian government&#8217;s\u00a0\u201cunusual and extraordinary policies and actions harming U.S. companies, the free speech rights of U.S. persons, U.S. foreign policy, and the U.S. economy.\u201d<\/p>\n<p><span data-contrast=\"auto\">On August 1, 2025, CBP published <\/span><a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3ec2577?wgt_ref=USDHSCBP_WIDGET_2\"><span data-contrast=\"none\">CSMS # 65807735,<\/span><\/a><span data-contrast=\"auto\"> which implements the updated tariff on imports from Brazil. Effective August 6, 2025, all imports from Brazil enter for consumption or withdrawn from the warehouse for consumption are subject to an additional 40% duty.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Exceptions: for products covered by the Section 232 Tariffs, the additional 40% duty will not be applied. The EO also excludes an extensive list of items that are not subject to the additional duties. View the full list of HTS codes in Annex I <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/07\/addressing-threats-to-the-us\/\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/span><\/p>\n<h3>India Tariffs Under IEEPA<br \/>\n<em>Status: Not in effect.<br \/>\nInitially took effect August 27, 2025, ended by Executive Order 14384 February 6, 2026.\u00a0<\/em><\/h3>\n<p>On August 6, 2025, the White House issued an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/08\/addressing-threats-to-the-united-states-by-the-government-of-the-russian-federation\/\">Executive Order<\/a> imposing an additional 25% tariff on imports from India. Effective August 27, imports from India will be subject to an extra 25% tariff in addition to the 25% India-specific Reciprocal Tariff, raising the total tariff on Indian imports to 50%. Note that goods subject to the current 50% Section 232 Tariff are excluded from the Reciprocal Tariff and this additional tariff on India.<\/p>\n<p><span data-contrast=\"auto\">On August 25, 2025, CBP published <a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3ef7e13?wgt_ref=USDHSCBP_WIDGET_2\">CSMS # 66027027<\/a>, which implemented the 25% IEEPA Russian Oil Tariff on India. Effective August 27, 2025, imports from India are subject to this 25% additional Russian Oil Tariff on top of the 25% IEEPA Reciprocal Tariff. Thus, Indian imports not exempted by the Russian Oil Tariff and the Reciprocal Tariff are subject to a total of 50% duty.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Shipments that are (1) in transit to the U.S. before August 27, 2025, and (2) entered for consumption before September 17, 2025, are exempt from this Russian Oil Tariff. In addition, goods under Annex II of the Reciprocal Tariff EO and Section 232 are also exempt from this Russian Oil Tariff.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p>On February 2, 2026, President Trump issued an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/02\/modifying-duties-to-address-threats-to-the-united-states-by-the-government-of-the-russian-federation-04b2\/\" target=\"_blank\" rel=\"noopener\">Executive Order<\/a> eliminating the additional 25% tariff on imports from India, finding that India had taken significant steps to address the issues identified in the August Executive Order.<\/p>\n<h3><strong>Steel and Aluminum Tariffs Under 232<br \/>\n<em>Status: In effect as of March 12, 2025, increase to 50% in effect as of June 4, 2025<\/em><\/strong><\/h3>\n<p>On February 11, 2025, President Trump\u00a0<a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/02\/fact-sheet-president-donald-j-trump-restores-section-232-tariffs\/\" target=\"_blank\" rel=\"noopener\">issued two Proclamations<\/a>\u00a0imposing enhanced import duties on\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/adjusting-imports-of-steel-into-the-united-states\/\" target=\"_blank\" rel=\"noopener\">steel\u00a0<\/a>and\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/adjusting-imports-of-steel-into-the-united-states-afbe\/\" target=\"_blank\" rel=\"noopener\">aluminum<\/a>\u00a0products under Section 232 of the Trade Expansion Act of 1962. The orders eliminate certain exemptions from the duties, expand their scope to cover additional products, and raise the duties on covered aluminum goods from 10% to 25%.<\/p>\n<p>On February 18, 2025, two Federal Register Notices were published that included lists of \u201cderivative\u201d products subject to the 25% tariffs on steel and aluminum under Section 232. The Federal Register Notices, which include the specific HTS subheadings for the derivative products in Annex 1 are available\u00a0<a href=\"https:\/\/www.federalregister.gov\/public-inspection\/2025-02833\/steel-imports-into-us-adjustments-proc-10896\" target=\"_blank\" rel=\"noopener\">here<\/a>\u00a0(Proclamation No. 10896 \u2013 Steel) and\u00a0<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2025-02-18\/pdf\/2025-02832.pdf\" target=\"_blank\" rel=\"noopener\">here<\/a>\u00a0(Proclamation No. 10895 \u2013 Aluminum).<\/p>\n<p>On March 2, 2025, the Department of Commerce (BIS) issued implementation instructions updating the Harmonized Tariff Schedule to reflect the new duty rates. These notices introduced new subheadings\u20149903.81.xx for steel and 9903.85.xx for aluminum\u2014and confirmed the effective date of March 12, 2025. (<em>See<\/em>:\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/03\/05\/2025-03598\/implementation-of-duties-on-steel-pursuant-to-proclamation-10896-adjusting-imports-of-steel-into-the\" target=\"_blank\" rel=\"noopener\">Implementation of Steel Duties Under Proclamation 10896<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/03\/05\/2025-03596\/implementation-of-duties-on-aluminum-pursuant-to-proclamation-10895-adjusting-imports-of-aluminum\" target=\"_blank\" rel=\"noopener\">Implementation of Aluminum Duties Under Proclamation 10895<\/a>)<\/p>\n<p>On March 11, 2025, the Secretary of Commerce certified that CBP had \u201c<em>adequate systems in place to fully, efficiently, and expediently process and collect tariff revenue\u201d<\/em>\u00a0for the expanded Section 232 duties on derivative steel and aluminum products\u2014including those classified outside of HTS Chapters 73 and 76. This certification was later\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/03\/14\/2025-04210\/certification-of-systems-for-processing-and-collecting-tariffs-on-steel-and-aluminum-articles\" target=\"_blank\" rel=\"noopener\">published<\/a>\u00a0in the Federal Register on March 14, 2025.<\/p>\n<p>Later that evening, CBP issued updated Cargo Systems Messaging Service (CSMS) guidance confirming that all derivative products\u2014including those classified outside of Chapters 73 and 76\u2014would be subject to the 25% duties for entries made on or after 12:01 AM on March 12, 2025. The CSMS message for Steel can be found\u00a0<a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3d66da7?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">HERE<\/a>.\u00a0 Aluminum\u00a0<a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3d66df0?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">HERE<\/a>.<\/p>\n<p>On June 3, 2025, President Trump signed a <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/06\/adjusting-imports-of-aluminum-and-steel-into-the-united-states\/\">Proclamation<\/a> increasing Section 232 tariffs on steel and aluminum from 25% to 50%. The same day, CBP published<span data-contrast=\"auto\">\u00a0<\/span><a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3e36e5e?wgt_ref=USDHSCBP_WIDGET_2\"><span data-contrast=\"none\">CSMS # 65236574<\/span><\/a><span data-contrast=\"auto\">, <\/span><a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3e36ea5?wgt_ref=USDHSCBP_WIDGET_2\"><span data-contrast=\"none\">CSMS # 65236645<\/span><\/a><span data-contrast=\"auto\">, and <\/span><a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3e36d96?wgt_ref=USDHSCBP_WIDGET_2\"><span data-contrast=\"none\">CSMS # 65236374<\/span><\/a><span data-contrast=\"auto\">, implementing the increase.<\/span><span data-ccp-props=\"{}\"> On June 9, 2025 CBP published additional guidance (<a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3e43b34?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">CSMS <\/a><\/span><a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3e43b34?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">65289012<\/a> <span data-ccp-props=\"{}\">&amp; <a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3e43a50?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">CSMS <\/a><\/span><a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3e43a50?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">65288784<\/a><span data-ccp-props=\"{}\">) updating the list of steel and aluminum HTS subject to 232 tariffs. CBP\u2019s instructions also include reporting guidance for separately declaring steel\/aluminum content and non-steel\/aluminum content for derivative products.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p>For derivative products classified under HTS Chapters 73 (steel) or 76 (aluminum), the 50% Section 232 tariff applies to the full value of the imported product. For derivatives classified <strong>outside of Chapters 73 and 76<\/strong>, the 50% duty applies only to the value of the steel or aluminum content within the product. Importers are encouraged to review CBP guidance on calculating content values (<em>See<\/em>:\u00a0<a href=\"https:\/\/www.cbp.gov\/trade\/programs-administration\/entry-summary\/232-tariffs-aluminum-and-steel\/faqs\" target=\"_blank\" rel=\"noopener\">Section 232 Tariffs on Steel and Aluminum Frequently Asked Questions<\/a>).<\/p>\n<p>The additional tariffs apply to all countries. This means that countries that previously had certain exemptions from the 232 tariffs such as Argentina, Australia, Brazil, Canada, the EU, Japan, Mexico, and South Korea are now subject to the 50% tariffs.<\/p>\n<p><span class=\"TextRun SCXW162379443 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW162379443 BCX4\">With respect to tariff stacking, only the non-steel\/aluminum content is subject to the 10% Reciprocal Tariff <\/span><span class=\"NormalTextRun SCXW162379443 BCX4\">and the steel\/aluminum content is exempted from <\/span><span class=\"NormalTextRun SCXW162379443 BCX4\">the Reciprocal Tariff. 301<br \/>\n<em>Status: <\/em><\/strong><strong><em>CBP suspended collection February 22, 2026 pursuant to the Supreme Court IEEPA decision<\/em><\/strong><\/h3>\n<p>On March 24, 2025, President Trump issued an\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/imposing-tariffs-on-countries-importing-venezuelan-oil\/\" target=\"_blank\" rel=\"noopener\">executive order<\/a>\u00a0enabling the Secretary of State to impose 25% tariffs on imports from countries that import oil from Venezuela. The order authorizes the Secretary of State, in consultation with the Secretary of the Treasury, the Secretary of Commerce, the Secretary of Homeland Security, and the United States Trade Representative, to determine whether the tariff of will be imposed on goods from any country that imports Venezuelan oil, directly or indirectly, on or after April 2, 2025.<\/p>\n<p>The additional tariffs are additional to any other duties and would expire one year after the last date on which the country imported Venezuelan oil.<\/p>\n<h3><strong>Automobile &amp; Automobile Parts Tariffs under 232<br \/>\n<em>Status:<br \/>\nAutomobiles: In effect as of April 3, 2025<br \/>\nAutomobile parts: In effect as of May 3, 2025\u00a0<\/em><\/strong><\/h3>\n<p>On March 26, 2025, President Trump issued a\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/adjusting-imports-of-automobiles-and-autombile-parts-into-the-united-states\/\" target=\"_blank\" rel=\"noopener\">Proclamation<\/a>\u00a0imposing a 25% tariff on automobiles and automobile parts<\/p>\n<p>\u201cAutomobiles\u201d includes passenger vehicles\u00a0(SUVs, crossovers, sedans, cargo vans, and light trucks). \u201cCertain automobile parts\u201d includes engines and engine parts, transmissions and powertrain parts, and electrical components. The full list of the subject merchandise can be access through Annex I of this\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/04\/03\/2025-05930\/adjusting-imports-of-automobiles-and-automobile-parts-into-the-united-states\" target=\"_blank\" rel=\"noopener\">Federal Register Notice<\/a>. The tariffs on automobiles went into effect on April 3. The tariffs on automobile parts went into effect on May 3.<\/p>\n<p>According to the\u00a0<a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/03\/fact-sheet-president-donald-j-trump-adjusts-imports-of-automobiles-and-automobile-parts-into-the-united-states\/\" target=\"_blank\" rel=\"noopener\">Fact Sheet<\/a>, for automobiles that qualify for preferential tariff treatment under the USMCA, importers may submit documentation identifying the amount of U.S. content in each automobile. The importer may then be eligible to apply the new tariff only to non-U.S. content.<\/p>\n<p>The 25% tariff will not apply to automobile parts that qualify for preferential treatment under the USMCA until the Secretary of Commerce establishes a process to apply the tariff exclusively to the value of non-U.S. content of automobile parts.<\/p>\n<p>The Federal Register notice can be found\u00a0<a href=\"https:\/\/www.federalregister.gov\/public-inspection\/2025-05930\/automobiles-and-automobile-parts-imports-into-us-adjustment-proc-10908\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n<p>On April 29, President Trump signed a Proclamation reducing duties for automakers that complete final assembly of vehicles in the U.S. These automakers will get a partial credit against the costs of 25% Section 232 tariffs on non-USMCA qualifying parts. Under the measure, carmakers may apply for an \u201cimport adjustment offset\u201d equal to 3.75% of the sticker price of all cars assembled in the U.S. from April 3, 2025 through April 30, 2026, and for an amount equal to 2.5% of the retail price from May 1, 2026 through April 30, 2027.<\/p>\n<p>On May 1, 2025, CBP published\u00a0<a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3de7ef9?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">CSMS # 64913145<\/a>, implementing the\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/04\/03\/2025-05930\/adjusting-imports-of-automobiles-and-automobile-parts-into-the-united-states\" target=\"_blank\" rel=\"noopener\">global automobile parts tariff<\/a>.<\/p>\n<p>The automobile parts tariff took effect\u00a0<strong><u>May 3, 2025<\/u><\/strong>, for all entries enter for consumption or withdrawn from warehouse for consumption.<\/p>\n<ul>\n<li>For entries of automobile parts without special tariff treatment, 25% duty will apply under HTS 9903.94.05.<\/li>\n<li>For entries of automobile parts that are (1) eligible for special tariff treatment,\u00a0<em>g.<\/em>, USMCA or (2) not subject merchandise, there will be no duty under HTS 9903.94.06.<\/li>\n<li>Not drawback is available for automobile parts tariff.<\/li>\n<\/ul>\n<p><span data-contrast=\"auto\">On September 24, the International Trade Administration (ITA) of the Department of Commerce (DOC) and the U.S. Trade Representative (USTR) jointly published a <a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/09\/25\/2025-18660\/implementing-certain-tariff-related-elements-of-the-us-eu-framework-on-an-agreement-on-reciprocal\">notice<\/a> regarding implementing <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/09\/modifying-the-scope-of-reciprocal-tariffs-and-establishing-procedures-for-implementing-trade-and-security-agreements\/\">Executive Order 14346<\/a>, which directed the DOC and USTR to implement frameworks for trade agreements reached between the United States and foreign governments.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Under this notice, auto and auto parts with a column 1, general duty of at least 15% will not be subject to the IEEPA Reciprocal Tariff. The total duty amount for auto and auto parts with a column 1, general duty of less than 15% will be capped at 15%.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><strong><em>CBP Compliance<\/em><\/strong><\/p>\n<p>If CBP determines that the importer has declared an inaccurate value of non-U.S. content is, the new 25% tariff will apply to the\u00a0full value\u00a0of the automobile.<\/p>\n<p>The new 25% tariff will be imposed\u00a0retroactively\u00a0to April 3 for all imports of the\u00a0same model\u00a0imported by the\u00a0same importer\u00a0until the importer corrects the overstatement and it is verified by CBP.<\/p>\n<p>Now more than ever it is critical for importers to have a USMCA compliance plan to ensure eligibility, keep proper records, and accurately document all non-U.S. content.<\/p>\n<h3><strong>Reciprocal Tariffs<br \/>\n<\/strong><a href=\"https:\/\/diaztradelaw.com\/trump-administration-announces-reciprocal-tariffs\/\" target=\"_blank\" rel=\"noopener\"><strong><em>Status:<\/em><\/strong><\/a><strong><em><br \/>\n10% baseline tariffs took effect April 5, 2025<\/em><em><br \/>\nCountry-specific tariff took effect August 7, 2025<br \/>\n<\/em><\/strong><strong><em>CBP suspended collection February 22, 2026 pursuant to the Supreme Court IEEPA decision<\/em><\/strong><\/h3>\n<p>On April 2, 2025, President Trump signed an\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/04\/regulating-imports-with-a-reciprocal-tariff-to-rectify-trade-practices-that-contribute-to-large-and-persistent-annual-united-states-goods-trade-deficits\/\" target=\"_blank\" rel=\"noopener\">Executive Order<\/a>\u00a0and issued a\u00a0<a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/04\/fact-sheet-president-donald-j-trump-declares-national-emergency-to-increase-our-competitive-edge-protect-our-sovereignty-and-strengthen-our-national-and-economic-security\/\" target=\"_blank\" rel=\"noopener\">Fact Sheet<\/a>\u00a0declaring a national emergency arising from conditions reflected in large and persistent annual U.S. goods trade deficits.<\/p>\n<p>Effective at 12:01 a.m. (ET) on April 5, 2025, the United States will impose a\u00a010%\u00a0ad valorem\u00a0baseline tariff on imports of all foreign-origin goods.\u00a0This baseline tariff is in addition to any other applicable duties or tariffs.<\/p>\n<p>The Executive Order also imposed country-specific tariff rates on imports from certain trading partners (listed in Annex I of the EO), which apply even if goods were imported under a free trade agreement. These rates include the 10% baseline tariff. View CBP guidance on the 10% tariff and reciprocal tariffs\u00a0<a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3daf1b6?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">here<\/a>. The country-specific rates were set to take effect April 9. However, President Trump issued an\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/04\/modifying-reciprocal-tariff-rates-to-reflect-trading-partner-retaliation-and-alignment\/\" target=\"_blank\" rel=\"noopener\">Executive Order<\/a>\u00a0pausing the country-specific tariff rates for 90 days for all countries listed in Annex I, except China.<\/p>\n<p><span data-contrast=\"auto\">On July 31, 2025, the White House announced the updated IEEPA Reciprocal Tariff on imports from countries around the globe. The <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/07\/further-modifying-the-reciprocal-tariff-rates\/\" target=\"_blank\" rel=\"noopener\">Executive Order<\/a> reinstated the country-specific IEEPA Reciprocal Tariff with updated tariff rates. Effective August 7, 2025, imports to the U.S. are subject to the country-specific IEEPA Reciprocal Tariff. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><i><span data-contrast=\"auto\">See<\/span><\/i><span data-contrast=\"auto\"> a Full List of IEEPA Reciprocal Tariff rates <\/span><a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2025\/07\/2025ReciprocalTariffs_7.31.eo_.pdf\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">On August 4, 2025, CBP published <\/span><a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3ec7b5e?wgt_ref=USDHSCBP_WIDGET_2\"><span data-contrast=\"none\">CSMS # 65829726<\/span><\/a><span data-contrast=\"auto\">, which implements the IEEPA Reciprocal Tariff from EO 14257 \u201c<\/span><a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/07\/further-modifying-the-reciprocal-tariff-rates\/#top\"><span data-contrast=\"none\">Further Modifying the Reciprocal Tariff Rates<\/span><\/a><span data-contrast=\"auto\">.\u201d\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Effective August 7, 2025, imports from countries identified in the EO 14257 are subject to each country\u2019s unique HTS code with a specific corresponding tariff rate. However, the IEEPA Reciprocal Tariff on imports from China currently remains at 10%.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Further, the updated IEEPA Reciprocal Tariff does not apply to goods from Canada and Mexico covered by the USMCA. Goods subject to the Section 232 Tariff are also excluded from the IEEPA Reciprocal Tariff.\u00a0<\/span><span data-ccp-props=\"{}\"> I<\/span><span data-contrast=\"auto\">f CBP determines that a shipment has been transshipped to evade the IEEPA Reciprocal Tariff, an additional 40% tariff will be applied on top of the Reciprocal Tariff. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span class=\"TextRun SCXW58985409 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW58985409 BCX4\">On September 5, 2025, President Trump signed <a class=\"Hyperlink SCXW58985409 BCX4\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/09\/modifying-the-scope-of-reciprocal-tariffs-and-establishing-procedures-for-implementing-trade-and-security-agreements\/\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"TextRun Underlined SCXW58985409 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"none\">Executive Order 14257<\/span><\/a> modifying the scope of reciprocal tariffs.\u00a0On September 6, 2025, <\/span><span class=\"NormalTextRun SCXW58985409 BCX4\">CBP published <\/span><\/span><a class=\"Hyperlink SCXW58985409 BCX4\" href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3f15174?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"TextRun Underlined SCXW58985409 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW58985409 BCX4\" data-ccp-charstyle=\"Hyperlink\">CSMS # 66151866<\/span><\/span><\/a><span class=\"TextRun SCXW58985409 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW58985409 BCX4\">, which implemented the EO, adding and removing <\/span><\/span><span class=\"TextRun SCXW58985409 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW58985409 BCX4\">certain goods from Annex II. <\/span><\/span><a class=\"Hyperlink SCXW58985409 BCX4\" href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2025\/04\/Annex-II.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"TextRun Underlined SCXW58985409 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW58985409 BCX4\" data-ccp-charstyle=\"Hyperlink\">Annex II<\/span><\/span><\/a><span class=\"TextRun SCXW58985409 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW58985409 BCX4\"> is a list that<\/span> <span class=\"NormalTextRun SCXW58985409 BCX4\">covers<\/span><span class=\"NormalTextRun SCXW58985409 BCX4\"> goods not subject to the IEEPA Reciprocal Tariff.\u00a0<\/span><\/span><span class=\"EOP SCXW58985409 BCX4\" data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><strong><em>China Reciprocal Tariffs<\/em><\/strong><\/p>\n<p>After China imposed retaliatory tariffs on U.S. goods, on April 8, 2025, President Trump issued an\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/04\/amendment-to-recipricol-tariffs-and-updated-duties-as-applied-to-low-value-imports-from-the-peoples-republic-of-china\/\" target=\"_blank\" rel=\"noopener\">Executive Order<\/a>\u00a0imposing additional tariffs on Chinese imports. The order amended the Administration\u2019s\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/04\/regulating-imports-with-a-reciprocal-tariff-to-rectify-trade-practices-that-contribute-to-large-and-persistent-annual-united-states-goods-trade-deficits\/\" target=\"_blank\" rel=\"noopener\">original reciprocal tariff<\/a>\u00a0of 34%, increasing it to 84%. On April 9, 2025, President Trump issued an\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/04\/modifying-reciprocal-tariff-rates-to-reflect-trading-partner-retaliation-and-alignment\/\" target=\"_blank\" rel=\"noopener\">Executive Order<\/a> increasing the rate again to 125%. This would have applied on top of the 20% IEEPA tariffs <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/further-amendment-to-duties-addressing-the-synthetic-opioid-supply-chain-in-the-peoples-republic-of-china\/\" target=\"_blank\" rel=\"noopener\">imposed in March<\/a>, bringing the total tariff on all imports from China to 145%.<\/p>\n<p>However, on May 12, 2025, President Trump signed an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/05\/modifying-reciprocal-tariff-rates-to-reflect-discussions-with-the-peoples-republic-of-china\/\" target=\"_blank\" rel=\"noopener\">Executive Order<\/a>\u00a0pausing China reciprocal tariffs for 90 days. CBP subsequently issued guidance implementing the 90-day suspension. View CSMS\u00a0<a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3e044d9?wgt_ref=USDHSCBP_WIDGET_2\" target=\"_blank\" rel=\"noopener\">here<\/a>. During this time, the 10% baseline tariff and the 20% IEEPA tariff on Chinese goods still applies, bringing the cumulative tariff on Chinese goods to 30%.<\/p>\n<p>On August 11, 2025, President Trump signed an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/08\/further-modifying-reciprocal-tariff-rates-to-reflect-ongoing-discussions-with-the-peoples-republic-of-china\/\">Executive Order<\/a> suspending China\u2019s specific reciprocal tariff until November 10, 2025. CBP subsequently published <a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3ed77f3?wgt_ref=USDHSCBP_WIDGET_2\">CSMS # 65894387<\/a>, implementing the Executive Order.<\/p>\n<p><span class=\"TextRun SCXW97240109 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW97240109 BCX4\">On November 1, 2025, the<\/span><span class=\"NormalTextRun SCXW97240109 BCX4\"> White House <\/span><span class=\"NormalTextRun SCXW97240109 BCX4\">released the\u202f<\/span><\/span><a class=\"Hyperlink SCXW97240109 BCX4\" href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/11\/fact-sheet-president-donald-j-trump-strikes-deal-on-economic-and-trade-relations-with-china\/\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"TextRun Underlined SCXW97240109 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"none\"><span class=\"NormalTextRun SCXW97240109 BCX4\" data-ccp-charstyle=\"Hyperlink\">latest update on<\/span><span class=\"NormalTextRun SCXW97240109 BCX4\" data-ccp-charstyle=\"Hyperlink\"> the U.S.-China trade negotiations<\/span><\/span><\/a><span class=\"TextRun SCXW97240109 BCX4\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW97240109 BCX4\">. Effective November 10, 2025, the IEEPA Reciprocal Tariff will decrease from 20% to 10%. The 10% IEEPA Reciprocal Tariff will remain in effect for another year,\u202funtil November 10, 2026.\u202f<\/span><\/span><\/p>\n<h3><strong>Tariff Stacking Executive Order<\/strong><\/h3>\n<p>On April 29<sup>th<\/sup>, President Trump issued an\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/04\/addressing-certain-tariffs-on-imported-articles\/\" target=\"_blank\" rel=\"noopener\">Executive Order<\/a>\u00a0specifying which tariffs \u201cstack\u201d and which do not. The Order aims to avoid the cumulative effect of overlapping tariffs on goods.<\/p>\n<p>The Order outlines how tariffs should be applied:<\/p>\n<p><em>Section 232 Automobile Tariff<\/em><\/p>\n<p>If this tariff applies, then the following tariffs do not apply:<\/p>\n<ul>\n<li>IEEPA Canada<\/li>\n<li>IEEPA Mexico<\/li>\n<li>Aluminum &amp; steel section 232<\/li>\n<\/ul>\n<p><em>Canada IEEPA<\/em>\u00a0\u2013 If this tariff applies, then aluminum and steel 232 tariffs do not apply.<\/p>\n<p><em>MX IEEPA\u00a0<\/em>\u2013 If this tariff applies, then aluminum and steel 232 tariffs do not apply.<\/p>\n<p><em>Steel &amp; Aluminum\u00a0<\/em>\u2013 If Section 232 steel tariffs apply, aluminum tariffs DO stack. Vice versa \u2013 if Section 232 aluminum tariffs apply, steel tariffs DO stack.<\/p>\n<p>The Order is retroactive to March 4, 2025.<\/p>\n<h3><strong>Copper Tariffs<br \/>\n<em>Status: In effect as of August 1, 2025<\/em><\/strong><\/h3>\n<p>In February 2025, the President signed an <a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/02\/fact-sheet-president-donald-j-trump-addresses-the-threat-to-national-security-from-imports-of-copper\/\">Executive Order<\/a> calling for a 232 investigation into the national security risks arising from the United States\u2019 increasing dependence on imported copper.<\/p>\n<p>On Wednesday, July 9, 2025, President Trump <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114826107762484260\">announced<\/a> that a 50% tariff on copper imports would take effect August 1, 2025. President Trump stated that the tariffs will be imposed to address the national security threat posed by foreign importer copper.<\/p>\n<p><span data-contrast=\"auto\">On July 31, 2025, CBP published CSMS <\/span><a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3ebf0e0?wgt_ref=USDHSCBP_WIDGET_2\"><span data-contrast=\"none\">#65794272<\/span><\/a><span data-contrast=\"auto\">, which officially implements the 50% tariff.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Effective August 1, 2025, all imports of copper and copper derivative products entered for consumption, or withdrawn from warehouse for consumption, will be subject to HTS code 9903.78.01. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The full list of copper and copper derivative products HTS codes can be found <a href=\"https:\/\/diaztradelaw.com\/wp-content\/uploads\/2025\/07\/CopperHTSlist073125.docx\" target=\"_blank\" rel=\"noopener\">here<\/a>. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h3><strong>De Minimis<br \/>\n<em>Status: De minimis exemption ended August 29, 2025<\/em><\/strong><\/h3>\n<p><span data-contrast=\"auto\">On July 30, 2025, the White House <\/span><a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/07\/suspending-duty-free-de-minimis-treatment-for-all-countries\/\"><span data-contrast=\"none\">announced<\/span><\/a><span data-contrast=\"auto\"> the suspension of the de minimis exemption. Currently, packages valued under $800 can enter the U.S. duty-free. Effective August 29, 2025, all shipments <\/span><i><span data-contrast=\"auto\">via<\/span><\/i><span data-contrast=\"auto\"> international postal service valued under $800 entered for consumption, or withdrawn from the warehouse for consumption, must be declared before CBP and subject to all applicable duties. Effective January 15, 2026, certain semiconductors and their derivative products under HTSUS 8471.50, 8471.80, and 8473.30 are subject to a 25% ad-valorem duty. According to CBP, the imported products must be a logic integrated circuit, or an article that contains a logic integrated circuit, that meets the technical parameters of having:<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">(1) a total processing performance (TPP) greater than 14,000 and less than 17,500, and a total DRAM bandwidth greater than 4,500 GB\/s and less than 5,000 GB\/s; or<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">(2) a TPP greater than 20,800 and less than 21,100, and total DRAM bandwidth greater than 5,800 GB\/s and less than 6,200 GB\/s.<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Certain semiconductors and their derivative products are excluded, such as semiconductors used for\/in data centers, research and development, emerging growth companies, consumer electronics, factory robotics, industrial machinery, and the public sector.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h3>Cuba IEEPA\/NEA Tariffs<br \/>\n<em>Status: Not yet in effect<\/em><\/h3>\n<p>On Jan. 29, 2026, President Trump issued an Executive Order titled <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/01\/addressing-threats-to-the-united-states-by-the-government-of-cuba\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Addressing Threats to the United States by the Government of Cuba<\/em><\/a>\u00a0and released an accompanying\u00a0<a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2026\/01\/fact-sheet-president-donald-j-trump-addresses-threats-to-the-united-states-by-the-government-of-cuba\/\" target=\"_blank\" rel=\"noopener noreferrer\">White House Fact Sheet<\/a>. The Executive Order declared a national emergency with respect to threats posed by Cuba\u2019s government and established a mechanism to impose additional tariffs on imports from countries that supply oil to Cuba.<\/p>\n<p>Under the framework: (1) the secretary of commerce will identify countries that supply oil to Cuba and share findings with the secretary of state; (2) in consultation with the Department of State, the Department of the Treasury, the Department of Homeland Security, and the U.S. trade representative, the secretary of state will recommend tariff levels; and (3) the president may then decide whether \u2014 and to what extent \u2014 to impose such duties.<\/p>\n<h3>Section 122 Tariffs<\/h3>\n<p>On February 20, 2026, President Trump <a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2026\/02\/fact-sheet-president-donald-j-trump-imposes-a-temporary-import-duty-to-address-fundamental-international-payment-problems\/\">announced<\/a>\u00a0he would replace the IEEPA tariffs with a tariff based on Section 122.\u00a0This was initially announced at 10% and took effect on February 24<sup>th<\/sup>.\u00a0The President has\u00a0<a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/116109447886304328\">announced<\/a>\u00a0that\u00a0he is increasing it to the lawful maximum of 15%, but the effective date has not yet been set. Effective October 14, 2025, timber and lumber is subject to a 10% duty, upholstered wooden products are subject to a 25% duty, and kitchen cabinets and vanities are subject to a 25% duty. If no agreement can be reached between the U.S. and foreign governments, beginning January 1, 2026, the duty for upholstered wooden products and kitchen cabinets and vanities will increase to\u00a0 30% and 50%, respectively. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The proclamation specifically included that goods subject to (1) IEEPA Reciprocal Tariff, (2) IEEPA Additional Tariff on Brazil, and (3) IEEPA Russian Oil Tariff are not subject to this Section 232 Tariff. Unlike the other Section 232 Tariffs, duty drawback is available for this tariff.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p>On December 31, 2025, President Trump issued a <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/12\/amendments-to-adjusting-imports-of-timber-lumber-and-their-derivative-products-into-the-united-states\/\" target=\"_blank\" rel=\"noopener\">Proclamation<\/a> amending tariffs on timber, lumber, and their derivative products. Effective January 1, 2027, the duty rate on imports of certain upholstered wooden products, as listed in Annex I will increase from 25% to 30% and the duty rate on imports of kitchen cabinets and vanities, as listed in Annex I will increase from 25% to 50%. The increase will\u00a0continue in effect, except for countries with which the United States reaches an agreement that addresses the threatened impairment of the national security posed by imports of wood products.<\/p>\n<p><em><strong>Vessel Fees<br \/>\nStatus: In effect as of October 14, 2025<\/strong><\/em><\/p>\n<p><span style=\"font-weight: 400;\">On October 3, 2025, CBP published guidance implementing the <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/04\/23\/2025-06927\/notice-of-action-and-proposed-action-in-section-301-investigation-of-chinas-targeting-the-maritime\"><span style=\"font-weight: 400;\">Section 301 Investigation of China\u2019s Targeting the Maritime, Logistics, and Shipbuilding Sectors<\/span><\/a><span style=\"font-weight: 400;\">, which was published on April 12, 2025, and<\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/06\/12\/2025-10660\/notice-of-proposed-modification-of-action-in-section-301-investigation-of-chinas-targeting-the\"> <span style=\"font-weight: 400;\">amended<\/span><\/a><span style=\"font-weight: 400;\"> on June 12, 2025. This Section 301 Investigation imposes new fees for vessels owned, operated, or built in China and for all foreign-built vehicle carrier vessels.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Service fees on Chinese vessel operators and owners began on October 14, 2025 at $50 per net ton. Below is a summary of the China and UK deals that have been agreed to thus far.<\/p>\n<h3><strong>China<\/strong><\/h3>\n<p>On May 12, 2025, the <a href=\"https:\/\/www.whitehouse.gov\/briefings-statements\/2025\/05\/joint-statement-on-u-s-china-economic-and-trade-meeting-in-geneva\/\" target=\"_blank\" rel=\"noopener\">White House<\/a> and the <a href=\"https:\/\/www.gov.cn\/yaowen\/liebiao\/202505\/content_7023399.htm\" target=\"_blank\" rel=\"noopener\">State Council<\/a> of China jointly published statements putting a pause on escalating tariff rates.<\/p>\n<p>According to the joint statement, China will lower the tariff on American imports to 10% for 90 days beginning May 14, 2025. The U.S. will simultaneously lower the China specific 125% Reciprocal Tariff to 10% for 90 days beginning May 14, 2025.<\/p>\n<p>The 10% IEEPA Reciprocal Tariff on all imports will remain in effect and other duties will continue to apply to Chinese imports, including Section 301 Tariff, Section 232 Tariff, and the IEEPA Fentanyl Tariff.<\/p>\n<p>CBP subsequently issued guidance implementing the 90-day suspension advising filers to replace HTSUS 9903.01.63 with 9903.01.25 to take advantage of the 10% tariff. The 10% IEEPA Reciprocal Tariff will remain in effect for another year,\u202funtil November 10, 2026.\u202f<\/span><span class=\"NormalTextRun SCXW97240109 BCX4\">Furthermore, the latest BIS 50% rule and the Section 301 investigation into China\u2019s maritime, <\/span><span class=\"NormalTextRun SCXW97240109 BCX4\">logistics<\/span><span class=\"NormalTextRun SCXW97240109 BCX4\">, and shipbuilding sectors will also be paused for another year, until November 10, 2026.\u00a0<\/span><\/span><span class=\"EOP SCXW97240109 BCX4\" data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<h3><strong>UK<\/strong><\/h3>\n<p>On May 8, 2025, President Trump and UK Prime Minister Keir <a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/05\/fact-sheet-u-s-uk-reach-historic-trade-deal\" target=\"_blank\" rel=\"noopener\">announced<\/a> a \u201chistoric\u201d trade deal aiming to eliminate trade barriers and provide market access for American exports.<\/p>\n<p>Agreement highlights:<\/p>\n<ul>\n<li>The agreement will not eliminate the 10 percent blanket reciprocal tariff.<\/li>\n<li>The U.S. will negotiate \u201calternative arrangements\u201d to its Section 232 tariffs on UK autos, steel, and aluminum.<\/li>\n<li>Streamlined customs procedures for U.S. exports<\/li>\n<li>Will establish a UK tariff-rate quota on U.S. ethanol, with a zero duty for imports under the quota<\/li>\n<li>The UK commits to reduce or eliminate numerous non-tariff barriers<\/li>\n<\/ul>\n<p>To date, each country has only released fact sheets concerning the agreement\u2019s details. Additional negotiations are expected.<\/p>\n<h3><strong>Vietnam<\/strong><\/h3>\n<p>On July 2, 2025 President Trump <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114784170652465525\">announced<\/a> a trade deal with Vietnam. According to the announcement, Vietnam will allow U.S. goods to enter the country duty-free and Vietnamese exports to the U.S. will face a 20% duty rate. The announcement also stated that goods being transshipped through Vietnam will face a 40% duty rate.<\/p>\n<h3><strong>Indonesia<\/strong><\/h3>\n<p>On July 15, 2025 President Trump <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114858589029028619\">announced via social media<\/a> that the U.S. and Indonesia had reached a trade deal. Under the deal, Indonesian imports will be subject to a 19% tariff. Exports to Indonesia are to be \u201ctariff and non-tariff barrier free.\u201d Indonesia has also committed to $20B in U.S. investment including\u00a0$15 billion in U.S. energy, $4.5 billion in American agricultural products, and 50 Boeing jets.<\/p>\n<h3>Japan<\/h3>\n<p>On July 22, 2025 President Trump <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114899417740854572\" target=\"_blank\" rel=\"noopener\">announced<\/a> a trade deal with Japan. A 15% tariff rate will apply to all Japanese imports. A 19% tariff rate will apply to all Philippine imports. The Philippines will reportedly open their markets to U.S. imports, tariff-free.<\/p>\n<h3>European Union (EU)<\/h3>\n<p>On July 27, President Trump <a href=\"https:\/\/www.nbcnews.com\/nightly-news\/video\/trump-outlines-preliminary-trade-deal-with-european-union-243911237616\" target=\"_blank\" rel=\"noopener\">announced<\/a> a trade deal with the EU. A 15% tariff will apply to most EU imports. Some categories of goods are exempt from new tariffs, including aircraft and plane parts, certain chemicals and some agricultural products. A 15% tariff will apply to most South Korean imports. South Korea also agreed to invest $350 billion in U.S. projects selected by Trump and to purchase energy products worth $100 billion.<\/p>\n<h3>Pakistan<\/h3>\n<p>On July 30, President Trump <a href=\"https:\/\/apnews.com\/article\/pakistan-washington-trade-deal-oil-reserves-development-b891d26a9047cba4c13f098be7e068d1\" target=\"_blank\" rel=\"noopener\">announced<\/a> a trade deal with Pakistan. A 19% tariff will apply to most imports from Pakistan. The deal will also allow the U.S. to help develop Pakistan&#8217;s largely untapped oil reserves.<\/p>\n<h3>Cambodia<\/h3>\n<p>The <a href=\"https:\/\/www.whitehouse.gov\/briefings-statements\/2025\/10\/agreement-between-the-united-states-of-america-and-the-kingdom-of-cambodia-on-reciprocal-trade\/\" target=\"_blank\" rel=\"noopener\">U.S.-Cambodia Agreement on Reciprocal Trade<\/a> was announced on October 26, 2025. The agreement reduces reciprocal tariffs from 49% to 19%. Cambodia agreed to eliminate tariffs on U.S. industrial goods and agricultural products. The U.S.\u00a0agreed to exempt certain products from the reciprocal tariff including agricultural and food products, raw materials and minerals, chemicals and pharmaceuticals, aircraft and parts, electronics and computing, industrial machinery and equipment, electrical equipment, wood products, textiles and fibers, precision instruments, and some metal products. Cambodia also agreed to work with the U.S. to address nontariff barriers and barriers to digital services trade.<\/p>\n<h3>Malaysia<\/h3>\n<div class=\"grid grid-cols-site grid-rows-1 gap-x-site-grid-gutter px-site-margin\" data-block=\"core\/paragraph\" data-block-start=\"core\/paragraph\" data-block-end=\"core\/paragraph\" data-block-align=\"\">\n<div class=\"lg:row-start-1 lg:row-end-1 col-span-full sm:col-span-8 lg:col-start-13 lg:col-end-25\">\n<p class=\"rich-text type-serif-body4\">The\u00a0<a href=\"https:\/\/www.whitehouse.gov\/briefings-statements\/2025\/10\/agreement-between-the-united-states-of-america-and-malaysia-on-reciprocal-trade\/\" target=\"_blank\" rel=\"noopener\">U.S.-Malaysia Agreement on Reciprocal Trade<\/a> was announced on October 26, 2025. The agreement reduces reciprocal tariffs from 24% to 19%. Malaysia agreed to eliminate tariffs on U.S. industrial goods and agricultural products, and the United States agreed to exempt certain products from the reciprocal tariff including agricultural and food products, pharmaceuticals, and more &#8211; full list in Annex 1 <a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2025\/10\/MALAYSIA-ANNEX_APPENDIX.pdf\" target=\"_blank\" rel=\"noopener\">here<\/a>.\u00a0 Malaysia agreed to work with the United States to address nontariff barriers and committed to purchase $150 billion in goods related to semiconductors, aerospace, and data centers over the next five years. Malaysia also agreed to facilitate U.S. investments in unspecified critical sectors, and \u201cto the extent practicable,\u201d invest $70 billion in the United States over the next ten years.<\/p>\n<h3>Thailand<\/h3>\n<div class=\"grid grid-cols-site grid-rows-1 gap-x-site-grid-gutter px-site-margin\" data-block=\"core\/paragraph\" data-block-start=\"core\/paragraph\" data-block-end=\"core\/paragraph\" data-block-align=\"\">\n<div class=\"lg:row-start-1 lg:row-end-1 col-span-full sm:col-span-8 lg:col-start-13 lg:col-end-25\">\n<p class=\"rich-text type-serif-body4\">The\u00a0<a href=\"https:\/\/www.whitehouse.gov\/briefings-statements\/2025\/10\/joint-statement-on-a-framework-for-a-united-states-thailand-agreement-on-reciprocal-trade\/\" target=\"_blank\" rel=\"noopener\">U.S.-Thailand Agreement on Reciprocal Trade<\/a> was announced October 26, 2025. The agreement lowers the reciprocal tariff rate from 32% to &#8220;no more than&#8221; 15%. The agreement also includes a zero percent reciprocal tariff for generic pharmaceuticals, their generic ingredients, aircraft components, and unavailable natural resources. Finally, Taiwanese semiconductor and technology enterprises agreed to make new, direct investments totaling at least $250 billion to build and expand advanced semiconductor, energy, and artificial intelligence production and innovation capacity in the United States.<\/p>\n<h3>India<\/h3>\n<div class=\"grid grid-cols-site grid-rows-1 gap-x-site-grid-gutter px-site-margin\" data-block=\"core\/paragraph\" data-block-start=\"core\/paragraph\" data-block-end=\"core\/paragraph\" data-block-align=\"\">\n<div class=\"lg:row-start-1 lg:row-end-1 col-span-full sm:col-span-8 lg:col-start-13 lg:col-end-25\">\n<p class=\"rich-text type-serif-body4\">A framework for an\u00a0<a href=\"https:\/\/www.whitehouse.gov\/briefings-statements\/2026\/02\/united-states-india-joint-statement\/\">Interim Agreement<\/a>\u00a0was announced in a joint statement on February 6, 2026. A White House\u00a0<a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2026\/02\/fact-sheet-the-united-states-and-india-announce-historic-trade-deal\/#:~:text=Fact%20Sheet%3A%20The%20United%20States%20and%20India%20Announce%20Historic%20Trade%20Deal,-The%20White%20House&amp;text=ACHIEVING%20RECIPROCAL%20TRADE%3A%20Last%20Friday,billion%20people%20to%20American%20products.\">fact sheet<\/a> was then released on February 9, 2026. The agreement reduces the reciprocal tariff rate from 25% to 18%. India agreed to eliminate or reduce tariffs on all U.S. industrial goods and a wide range of food and agricultural products. The United States agreed to remove Section 232 tariffs on certain aircraft and aircraft parts from India, give India preferential tariff rate quotas (TRQs) for automotive parts, and negotiate tariffs on pharmaceuticals and ingredients once the pending 232 investigation is complete. India agreed to address nontariff barriers, and barriers to\u00a0digital trade. Finally, India agreed to purchase commitments\u00a0of $500 billion of U.S. energy products, aircraft and parts, precious metals, technology products, and cooking oil over the next five years.<\/p>\n<h3>Bangladesh<\/h3>\n<div class=\"grid grid-cols-site grid-rows-1 gap-x-site-grid-gutter px-site-margin\" data-block=\"core\/paragraph\" data-block-start=\"core\/paragraph\" data-block-end=\"core\/paragraph\" data-block-align=\"\">\n<div class=\"lg:row-start-1 lg:row-end-1 col-span-full sm:col-span-8 lg:col-start-13 lg:col-end-25\">\n<p class=\"rich-text type-serif-body4\">The\u00a0<a href=\"https:\/\/www.whitehouse.gov\/briefings-statements\/2026\/02\/joint-statement-on-framework-for-united-states-bangladesh-agreement-on-reciprocal-trade\/\">U.S.-Bangladesh Agreement on Reciprocal Trade<\/a> was announced on February 9, 2026. The agreement reduces the reciprocal tariff rate from 37% to 19% Bangladesh agreed to provide preferential market access for U.S. industrial and agricultural goods, including beef, chemicals, dairy, energy products, medical devices, and soy.
