The April 2\u00a0 \u201cLiberation Day\u201d announcement of new sweeping tariffs makes it crystal clear that the\u00a0president means business.<\/p>\n<p id=\"ember1156\" class=\"ember-view reader-text-block__paragraph\">New <a class=\"DgyYRhiNYAgnOCxRZXaozXbEhNkWmmmFogVQ \" tabindex=\"0\" href=\"https:\/\/www.bbc.com\/news\/articles\/c1jxrnl9xe2o\" target=\"_self\" data-test-app-aware-link=\"\">U.S. tariffs<\/a> on goods from Canada, Mexico, and China are estimated to<a class=\"DgyYRhiNYAgnOCxRZXaozXbEhNkWmmmFogVQ \" tabindex=\"0\" href=\"https:\/\/www.wsj.com\/opinion\/donald-trump-tariffs-canada-mexico-china-working-class-voters-dc140dbc\" target=\"_self\" data-test-app-aware-link=\"\"> increase tax revenue by $600\u2013650 billion<\/a> over ten years. These policy-related measures that can restrict trade between countries include quotas, licensing requirements, import bans, subsidies, customs procedures, technical regulations, and standards.<\/p>\n<p id=\"ember1158\" class=\"ember-view reader-text-block__paragraph\">In the global context, non-tariff barriers to trade (NTBs) can increase the cost of trade by raising compliance costs, delaying shipments, and adding layers of bureaucracy. For example, a World Trade Organization report<a class=\"DgyYRhiNYAgnOCxRZXaozXbEhNkWmmmFogVQ \" tabindex=\"0\" href=\"https:\/\/www.wto.org\/english\/res_e\/booksp_e\/anrep_e\/wtr12-2d_e.pdf\" target=\"_self\" data-test-app-aware-link=\"\">found<\/a> that NTBs raised global trade costs especially for developing countries and small firms within them. One estimate from 2019 suggested that the cost of NTBs in terms of the lost potential for global trade was as high as <a class=\"DgyYRhiNYAgnOCxRZXaozXbEhNkWmmmFogVQ \" tabindex=\"0\" href=\"https:\/\/unctad.org\/news\/trade-costs-non-tariff-measures-now-more-double-tariffs#:~:text=The%20average%20cost%20of%20these%20measures%20alone,can%20even%20boost%20trade%20under%20certain%20conditions\" target=\"_self\" data-test-app-aware-link=\"\">$1.4 trillion<\/a>.<\/p>\n<p id=\"ember1159\" class=\"ember-view reader-text-block__paragraph\">The impact of NTBs on U.S. trade specifically results in<a class=\"DgyYRhiNYAgnOCxRZXaozXbEhNkWmmmFogVQ \" tabindex=\"0\" href=\"https:\/\/ustr.gov\/sites\/default\/files\/files\/Press\/Reports\/2025NTE.pdf\" target=\"_self\" data-test-app-aware-link=\"\">increased costs<\/a>for exports on average. Barriers such as stringent product standards, licensing requirements, and customs procedures can make it more expensive for U.S. firms to export goods abroad. Certain sectors, such as agriculture, automobiles, and pharmaceuticals, are more heavily affected by NTBs.<\/p>\n<p id=\"ember1160\" class=\"ember-view reader-text-block__paragraph\">For instance,<a class=\"DgyYRhiNYAgnOCxRZXaozXbEhNkWmmmFogVQ \" tabindex=\"0\" href=\"https:\/\/theconversation.com\/what-are-non-tariff-barriers-and-why-is-agriculture-so-exposed-252739\" target=\"_self\" data-test-app-aware-link=\"\">U.S. farmers<\/a> face sanitary and phytosanitary regulations in foreign markets that make it difficult to access these markets, reducing the global competitiveness of U.S. agricultural exports. Additionally, NTBs affect global supply chains by creating additional layers of regulation and inspection. This disrupts the free flow of components and products, increasing the cost of production for U.S. companies that depend on imported raw materials or parts.<\/p>\n<p id=\"ember1161\" class=\"ember-view reader-text-block__paragraph\">Some studies have suggested that NTBs <a class=\"DgyYRhiNYAgnOCxRZXaozXbEhNkWmmmFogVQ \" tabindex=\"0\" href=\"https:\/\/www.instituteforgovernment.org.uk\/article\/explainer\/non-tariff-barriers#:~:text=do%20they%20matter%3F-,Non%2Dtariff%20barriers%20can%20be%20more%20restrictive%20for%20trade%20than,Today%20it%20is%203.5%25....also\" target=\"_self\" data-test-app-aware-link=\"\">can be more restrictive<\/a> to overall global trade than tariffs.<\/p>\n<p id=\"ember1162\" class=\"ember-view reader-text-block__paragraph\">This is because they are <a class=\"DgyYRhiNYAgnOCxRZXaozXbEhNkWmmmFogVQ \" tabindex=\"0\" href=\"https:\/\/www.zora.uzh.ch\/id\/eprint\/195436\/\" target=\"_self\" data-test-app-aware-link=\"\">more complex<\/a>, unpredictable, and difficult to measure. While tariffs are clear, NTBs can be vague or selectively enforced, making them harder for businesses to navigate; they also have higher compliance costs, which harm small and medium-sized enterprises (SMEs) that lack the resources to comply with varying international rules. Unpredictable and subject to discretionary enforcement, NTBs are more effective than tariffs in restricting trade as they can be disguised as necessary regulations. Additionally, NTBs can give domestic companies an unfair advantage by making it more difficult for foreign competitors to enter the market.<\/p>\n<p id=\"ember1163\" class=\"ember-view reader-text-block__paragraph\">The NTB domain shows no sign of abatement, with issues ranging from import quotas and bans to specious technical requirements and weak intellectual property protection. For example,<a class=\"DgyYRhiNYAgnOCxRZXaozXbEhNkWmmmFogVQ \" tabindex=\"0\" href=\"https:\/\/www.strtrade.com\/trade-news-resources\/str-trade-report\/trade-report\/january\/ustr-reports-on-global-ipr-enforcement-efforts\" target=\"_self\" data-test-app-aware-link=\"\"> USTR reports that thirty-three markets<\/a>, including Argentina, China, Mexico, Peru, and Thailand, have inadequate IPR protection with little sign of improvement.<\/p>\n<p id=\"ember1164\" class=\"ember-view reader-text-block__paragraph\">To illustrate, <a class=\"DgyYRhiNYAgnOCxRZXaozXbEhNkWmmmFogVQ \" tabindex=\"0\" href=\"https:\/\/www.state.gov\/reports\/2024-investment-climate-statements\/brazil\/\" target=\"_self\" data-test-app-aware-link=\"\">in Brazil<\/a>, foreign firms may only bid to provide technical services if there are no qualified Brazilian firms. Some of the most obstructive NTBs include China\u2019s technology and data localization requirements, the EU\u2019s food and agricultural import restrictions, and India\u2019s high testing and certification requirements for medical devices.<\/p>\n<p id=\"ember1165\" class=\"ember-view reader-text-block__paragraph\">The resources available to the U.S. government to counter NTBs are trade negotiations and diplomatic pressure, as well as retaliatory measures and enforcement based on Section 301 investigations, specifically countervailing duties and anti-dumping measures if warranted. But here, too, there has not been significant progress.<\/p>\n<p id=\"ember1166\" class=\"ember-view reader-text-block__paragraph\">U.S. trade policy today is a roller coaster, and the only thing predictable about it is its unpredictability. Within this milieu, the sole fixation on tariffs neglects the impacts of non-tariff barriers\u2014impediments that are far worse, for whereas tariff rates can rise and fall based on government whim, NTBs are harder to reverse (witness the EU\u2019s policies on GMOs).<\/p>\n<p id=\"ember1167\" class=\"ember-view reader-text-block__paragraph\">It behooves policymakers in both parties to come together on this one bipartisan commercial issue since the main beneficiaries of trade barrier removal will be their states\u2019 and districts\u2019 exporters.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>We are pleased to share our latest feature in the National Interest!
