Some have speculated on whether President Trump\u2019s stance on Cuba would further diplomatic relations following the steps of former President Barack Obama, while the majority have opined that Trump\u2019s next steps could reverse some of the changes made by the former President. The speculation can now be put to the side as today <a href=\"https:\/\/www.youtube.com\/watch?v=gTeItJKJByk\">President Trump delivered a speech in Miami <\/a>(at the Manuel Artime Theater), a little over 90 miles away from the island of Cuba, outlining his new policy with the communist island. <strong>The announced changes do not take effect until the new OFAC regulations are issued. The forthcoming regulations will be prospective and will not affect existing contracts and licenses.<\/strong> <strong>\u00a0<\/strong><\/p>\n<p style=\"text-align: left;\"><strong>Here is a summary of the MAIN changes, and background of why the President has signed an executive order making these changes in support of the Cuban people:<\/strong><\/p>\n<p><!--more--><\/p>\n<ul>\n<li style=\"text-align: left;\"><strong>No new <\/strong>direct transactions with entities related to the Cuban military, intelligence, or security services.\n<ul>\n<li>The State Department will be publishing a list of entities with which direct transactions generally <strong>will not be permitted.<\/strong><\/li>\n<li>President Trump advised \u201cwe will very strongly restrict American dollars flowing to the military,\u201d \u201cwe will take concrete steps to ensure investments flow directly to the Cuban people\u201d.<\/li>\n<\/ul>\n<\/li>\n<li style=\"text-align: left;\">The 12 categories of authorized travel will remain, BUT, there will be an end to \u201c<a href=\"http:\/\/customsandinternationaltradelaw.com\/2016\/03\/16\/build-your-own-people-to-people-mission-more-cuba-changes\/\">people to people\u201d travel on your own<\/a> (group travel is not impacted). President Trump stated \u201ceasing restrictions on travel and trade does not help the Cuban people, they only enrich the Cuban regime\u201d. \u201cThe profits from investment and tourism flow directly to the military, the regime takes the money and owns the industry.\u201d<\/li>\n<li style=\"text-align: left;\">President Trump stated: \u201cwe will not lift sanctions on the Cuban regime until \u201call political prisoners are free, freedoms of assembly and expression are respected, all political parties are legalized, and free and internationally supervised elections are scheduled.\u201d<\/li>\n<li style=\"text-align: left;\">Remittances will NOT be impacted.<\/li>\n<li style=\"text-align: left;\"><strong>We can expect the new provisions to be actively enforced. President Trump advised: \u201cour new policy begins with STRICTLY ENFORCING U.S. law\u201d. <a href=\"http:\/\/customsandinternationaltradelaw.com\/2016\/03\/16\/build-your-own-people-to-people-mission-more-cuba-changes\/#more-1992\">Review our previous travel tips<\/a> to you, and ensure you meet them!<\/strong><\/li>\n<li style=\"text-align: left;\">The Embargo will REMAIN in place.<\/li>\n<\/ul>\n<p><strong><em>WHAT HAPPENS NEXT?<\/em><\/strong><\/p>\n<ul>\n<li>OFAC will implement the Treasury-specific changes via amendments to its Cuban Assets Control Regulations (CACR). The above changes will be effective as soon as the OFAC issues new regulations.<\/li>\n<li>The Department of Commerce will implement any necessary changes via amendments to its Export Administration Regulations (EAR).<\/li>\n<li>OFAC expects to issue its regulatory amendments in the coming months.<\/li>\n<\/ul>\n<p><strong>The White House released a <a href=\"https:\/\/www.whitehouse.gov\/blog\/2017\/06\/16\/fact-sheet-cuba-policy\">Fact Sheet on Cuba Policy<\/a> moments prior to President Trump&#8217;s announcement and The OFAC has already provided a three page <a href=\"https:\/\/www.treasury.gov\/resource-center\/sanctions\/Programs\/Documents\/cuba_faqs_20170616.pdf\">FAQ<\/a> on its website discussing the main questions and answers you are likely pondering yourself.<\/strong><\/p>\n<p><strong><em>FORTHCOMING OFAC REGULATIONS<\/em><\/strong><\/p>\n<p><strong><em>Direct Transactions with Entities Related to The Cuban Military, Intelligence, or Security Services Are Permitted Until OFAC Issues New Regulations.<\/em><\/strong><\/p>\n<ul>\n<li>Consistent with the Administration\u2019s interest in not negatively impacting American businesses for engaging in lawful commercial opportunities, any Cuba-related commercial engagement that includes direct transactions with entities related to the Cuban military, intelligence, or security services that may be implicated by the new Cuba policy will be <strong><u>permitted<\/u><\/strong> <strong>ONLY IF<\/strong> those commercial engagements were in place <strong>prior<\/strong> to the issuance of OFAC forthcoming regulations. The forthcoming regulations will be prospective and will not affect existing contracts and licenses.<\/li>\n<li>The State Department will be publishing a list of entities with which direct transactions generally <strong>will not be permitted<\/strong>. Guidance will accompany the issuance of the new regulations. Following the issuance of OFAC\u2019s regulatory changes, travel-related transactions with prohibited entities identified by the State Department generally will not be permitted.<\/li>\n<\/ul>\n<p><strong><em>Ban on Individual people-to-people travel<\/em><\/strong><\/p>\n<ul>\n<li>The President instructed Treasury to issue regulations that will <strong>end individual people-to-people travel.<\/strong> The announced changes do not take effect until the new regulations are issued. Individual people-to-people travel is educational travel that:\n<ul>\n<li>does not involve academic study pursuant to a degree program; and<\/li>\n<li>does not take place under the auspices of an organization that is subject to U.S. jurisdiction that sponsors such exchanges to promote people-to-people contact.<\/li>\n<\/ul>\n<\/li>\n<li>Individual people-to-people travelers who have <strong>already begun making their travel arrangements<\/strong> (such as purchasing flights, hotels, or rental cars) are authorized to travel, whether the trip occurs before or after OFAC\u2019s new regulations are issued<strong>, <em>ONLY IF<\/em><\/strong> the traveler has already completed at least one travel-related transaction (such as purchasing a flight or reserving accommodation) prior to the President\u2019s announcement on June 16, 2017. Please note, the travel-related transactions MUST BE consistent with OFAC\u2019s regulations as of June 16, 2017.<\/li>\n<\/ul>\n<p><strong><em>Group People-to-People Travel<\/em><\/strong><\/p>\n<ul>\n<li>Group people-to-people travel is educational travel <strong><em>not involving academic study pursuant to a degree program that takes place under the auspices of an organization that is subject to U.S. jurisdiction that sponsors such exchanges to promote people-to-people contact.<\/em><\/strong><\/li>\n<li>Travelers utilizing this travel authorization <strong>must maintain<\/strong> a full-time schedule of educational exchange activities that are intended to enhance contact with the Cuban people, support civil society in Cuba, or promote the Cuban people\u2019s independence from Cuban authorities, and that will result in meaningful interaction between the traveler and individuals in Cuba.<\/li>\n<li>An employee, consultant, or agent of the group <strong>must accompany<\/strong> each group to ensure that each traveler maintains a full-time schedule of educational exchange activities.<\/li>\n<\/ul>\n<p><strong><em>TRAVEL TIPS<\/em><\/strong><\/p>\n<ul>\n<li>KEEP\u00a0<strong>RECORDS<\/strong>\u00a0for\u00a0<strong>5 Years.\u00a0<\/strong><\/li>\n<li><strong>Ensure\u00a0<\/strong>you DO meet one of the 12 \u201cAuthorized Traveler\u201d Categories.\u00a0<strong>NO purely \u201ctouristic\u201d visits<\/strong>. Consult\u00a0<a href=\"https:\/\/www.treasury.gov\/resource-center\/sanctions\/Programs\/Documents\/cuba_faqs_new.pdf\">OFAC\u2019s FAQ\u2019s<\/a>, if still unsure, contact your lawyer to determine\u00a0if you fit into one of these 12:\n<ul>\n<li>family visits; official business of the U.S. government, foreign governments, and certain intergovernmental organizations; journalistic activity; professional research and professional meetings; educational activities; religious activities; public performances, clinics, workshops, athletic and other competitions, and exhibitions; support for the Cuban people; humanitarian projects; activities of private foundations or research or educational institutes; exportation, importation, or transmission of information or information materials; and certain authorized export transactions.<\/li>\n<\/ul>\n<\/li>\n<li>Make sure you have a travel\u00a0<strong>agenda<\/strong>\u00a0detailing your appointments (if they don\u2019t fill up a \u201cFULL DAY,\u201d you\u2019re not done drafting it, and maybe will need a travel sponsor for your people to people mission after all).<\/li>\n<li>If you\u2019re participating in a \u2018People to People\u2019 mission, do so under a group to qualify for \u201csupport for the Cuban people\u201d and ask yourself (hint, at least one answer should be YES), does this agenda seek to\u00a0<strong>enhance contact with the Cuban people, support civil society in Cuba, or promote the Cuban people\u2019s independence from Cuban authorities?<\/strong><\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><strong>The following are NOT affected by President Trump\u2019s announcement:<\/strong><\/p>\n<ul>\n<li>12 categories of authorized travel\n<ul>\n<li>Following the issuance of OFAC\u2019s regulatory changes, travel-related transactions with prohibited entities identified by the State Department generally will <strong>not be permitted<\/strong>.
