TSA approves applications for companies to become an IAC. Diaz Trade Law can advise if your company should proceed with the IAC application and assist you in reviewing your obligations under the TSA laws and regulations, including the known shipper program.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><span style=\"font-size: small;\"><b>Penalty mitigation<\/b><\/span>\n<ul>\n<li><span style=\"font-size: small;\">The Transportation Security Administration (TSA) <\/span><span style=\"font-size: small;\">was created to strengthen the security of the nation\u2019s transportation systems and ensure the freedom of movement for people and commerce. TSA regulates IAC&#8217;s and often issues penalties, pursuant to its<\/span><span style=\"font-size: small;\">regulations in 49 CFR Part 1503 (Investigative and Enforcement Procedures). The regulations discuss how and when TSA may issue a monetary civil penalties against an airline or IAC (a.k.a. &#8220;licensed freight forwarder&#8221;) for a violation of the Transportation Security Regulations.<\/span><\/li>\n<li><span style=\"font-size: small;\"><i><b>What is the Penalty Process?<\/b><\/i><\/span>\n<ul>\n<li><span style=\"font-size: small;\">First, a TSA attorney is assigned, and drafts a Notice of Proposed Civil Penalty against the alleged violator (the<\/span><span style=\"color: #333333;\"><span style=\"font-size: small;\"> airline or IAC). The Notice contains the underlying facts which lead to the violation, the relevant TSA law and regulation allegedly violated, and provides 30 days for to respond.\u00a0 The penalty notice may be sent to the President or CEO of the company, or to the TSA-designated security coordinator (make sure it is not disregarded).<\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #333333;\"><span style=\"font-size: small;\"><i><b>What are Your Options?<\/b><\/i><\/span><\/span>\n<ul>\n<li><span style=\"color: #333333;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: small;\">The airline or IAC that receives such a Notice has several options (written from my preferred methods of response first to least preferred last):<\/span><\/span>\n<ul>\n<li><span style=\"font-size: medium;\"><span style=\"color: #333333;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: small;\">request an informal conference with the TSA attorney identified in the Notice;<\/span><\/span><\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: medium;\"><span style=\"color: #333333;\"><span style=\"font-size: small;\">write back to the TSA and attempt to persuade the TSA that the violation did not occur;<\/span><\/span><\/span><\/span><\/li>\n<li><span style=\"font-size: medium;\"><span style=\"color: #333333;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: small;\">plead that the individual or company does not have the money to pay the penalty;<\/span><\/span><\/span><\/li>\n<li><span style=\"font-size: medium;\"><span style=\"color: #333333;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: small;\">demand a hearing before an Administrative Law Judge; or<\/span><\/span><\/span><\/li>\n<li><span style=\"font-size: medium;\"><span style=\"color: #333333;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: small;\">pay the penalty in full.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-size: medium;\"><span style=\"color: #333333;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: small;\"><i><b>How Can Diaz Trade Law Help?<\/b><\/i><\/span><\/span><\/span>\n<ul>\n<li><span style=\"font-size: medium;\"><span style=\"color: #333333;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: small; text-align: justify; display: inline-block; vertical-align: top;\">From past experience, it is best to request to meet with the TSA attorney who issued the penalty notice as part of an informal conference. Informal conferences may be held by telephone or in person. I prefer in person and often suggest an officer of the company that allegedly violated the cited TSA regulations, or the security coordinator attend as well to describe the incident that led to the Notice and most importantly, the corrective actions taken by the company and all mitigating factors present. U.S.-based companies or sole proprietors operating as Ocean Freight Forwarders (OFF) or Non-Vessel-Operating Common Carriers (NVOCCs) are required to obtain a license from the FMC. Non-U.S.-based NVOCCs are not required, but may apply for a FMC-issued license. The TTB issues permits for companies to operate as an importer and wholesaler of alcoholic beverages in the U.S. TTB also strictly regulates the labels that appear on all alcoholic beverages. Each state and municipality has additional laws that may further regulate alcoholic beverage distribution, importation, storage, wholesale and retail operations. Also, each state and municipality may issue its own permit to allow businesses to perform these business operations.<\/span><\/span><\/p>\n<ul>\n<li><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>Importing<\/b><\/span><\/span>\n<ul>\n<li><span style=\"font-size: small;\"><span lang=\"en-GB\">To import alcohol into the U.S. you must meet several requirements:<\/span><\/span><\/li>\n<li><span style=\"font-size: small;\"><span lang=\"en-GB\">Complete an Importers Basic Permit with the TTB<\/span><\/span><\/li>\n<li><span style=\"font-size: small;\"><span lang=\"en-GB\">Depending on your business model, complete a Wholesalers Basic Permit with the TTB<\/span><\/span><\/li>\n<li><span style=\"font-size: small;\"><span lang=\"en-GB\">Obtain a TTB-issued Certificate of Label Approval (COLA) for each unique product\/label.<\/span><\/span><\/li>\n<li><span style=\"font-size: small;\"><span lang=\"en-GB\">Alcohol is treated as a food by the U.S. FDA, therefore you must also register as a food facility under FDA\u2019s Food Facility Registration before importing or distributing alcoholic beverages in the U.S.<\/span><\/span><\/li>\n<li><span style=\"font-size: small;\"><span lang=\"en-GB\">Our team assists with all TTB permits, and label reviews and assists in completing the COLA.<\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-size: small;\"><span lang=\"en-GB\">Alcohol and Tobacco Tax and Trade Bureau (TTB)<\/span><\/span>\n<ul>\n<li><a href=\"http:\/\/www.ttb.gov\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: small;\"><span lang=\"en-GB\">http:\/\/www.ttb.gov<\/span><\/span><\/a><\/li>\n<li><a href=\"http:\/\/www.ttb.gov\/itd\/importing_alcohol.shtml\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: small;\"><span lang=\"en-GB\">http:\/\/www.ttb.gov\/itd\/<wbr \/>importing_alcohol.shtml<\/span><\/span><\/a><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n<h1>Bureau of Economic Analysis<\/h1>\n<p>The Bureau of Economic Analysis is a division of the U.S. Department of Commerce whose primary mission is to provide accurate and objective economic data that inform critical policy decisions. It specifically monitors and analyzes foreign direct investment (FDI) into and out of the United States, which is reported to Congress with the intention of stimulating U.S. economic growth.<\/p>\n<p>The BEA requires any U.S. business enterprise, except certain private funds, in which 1) at least 10% of the U.S. business has been acquired by a foreign entity, and 2) the acquisition cost greater than $40 million, to report the acquisition, expansion, or creation of its business in the U.S. Similarly, the U.S. entity with a foreign affiliate must report its outbound investment to the BEA.<\/p>\n<p>Diaz Trade Law has expertise and a strong track record on BEA matters.
